Section 702 of the Foreign Intelligence Surveillance Act has temporarily expired. According to the Electronic Frontier Foundation, this authority allowed U.S. intelligence agencies to collect communications from people abroad without a warrant, while routinely sweeping up Americans' emails and phone calls in the process. The program was set to expire on June 12th at midnight after months of congressional delay. The expiration comes amid disagreement over oversight: Senate Democrats blocked reauthorization after the nomination of Bill Pulte—who has no intelligence or military background—as Director of National Intelligence. The EFF has long argued that Section 702 should require a warrant before the FBI accesses Americans' communications. For now, that authority remains expired, at least temporarily.
