Terms of Service

These Terms of Service ("Terms") govern your access to and use of The Chonkerton (the "Service"), a personalized audio news digest service operated by Conch Labs LLC ("we", "us", or "Conch Labs"). By creating an account or using the Service, you agree to these Terms.

1. The Service

The Chonkerton provides on-demand audio summaries of current news, narrated by AI-generated voices. Audio content is generated from public RSS sources or sources for which we have explicit author consent. The summaries you hear are AI-generated. We disclose this openly because we believe transparent AI use is better for everyone than hidden AI use.

2. Free and Paid Tiers

Free tier: Unlimited listening, supported by audio ads inserted between stories.
Paid tier ($5/month, recurring): Same content as the free tier, with no ads. Billed monthly via Stripe. You may cancel at any time from your account; cancellation takes effect at the end of your current billing period.
Free trial: The paid tier may be started with a 7-day free trial. A valid payment method is required to begin the trial. You will not be charged if you cancel before the trial ends; if you do not cancel, your card is automatically charged $5 and the monthly subscription begins.

Refunds: If you're dissatisfied, email us within 7 days of a charge and we'll refund it in full, no questions asked. Beyond 7 days, refunds are handled case by case at our discretion. Refunds are issued to the original payment method via Stripe.

3. Accounts

You're responsible for keeping your account credentials secure. You agree to provide accurate information when signing up, and you agree not to share your account with others. We may suspend accounts that violate these Terms, abuse the Service, or attempt to circumvent the paid tier through automated means.

4. Content and Sourcing

All audio content is original transformative summarization of publicly available source material, with attribution to the original source. We do not redistribute paywalled or copyrighted audio. Our content sourcing policy permits public RSS feeds, sources with explicit author consent, and public-domain material; sources outside this scope are excluded from playlist assembly.

5. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of these Terms;
Attempt to reverse-engineer, scrape, or systematically extract content from the Service;
Resell, redistribute, or rebroadcast Chonkerton audio content without written permission;
Interfere with the Service's operation or security.

6. Disclaimers

The Service is provided "as is." We make no warranty that AI-generated summaries are accurate, complete, or free from error. Do not rely on The Chonkerton as the sole source for any decision of consequence. News is summarized for convenience, not for substitution of primary reporting.

7. Limitation of Liability

To the maximum extent permitted by law, Conch Labs LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you have paid us in the twelve months preceding the claim.

8. Termination

You may cancel a paid subscription and delete your account at any time from your account settings; account deletion removes your associated data. We may terminate or suspend access for any user who materially breaches these Terms.

9. Changes

We may update these Terms occasionally. Material changes will be communicated via the email address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

10. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-laws principles. Disputes shall be resolved in the state and federal courts located in Colorado.
