The Ninth Circuit Court of Appeals found that many detainees should have been eligible for bail hearings while their deportation cases proceed — a practice that has distinguished between immigrants detained at the border versus those detained inland for over thirty years. The administration's approach, which doesn't make that distinction, has overwhelmed detention centers and flooded federal courts with release requests. The divided ruling — issued by a Trump-appointed judge — will almost certainly reach the Supreme Court.
