Dismiss Church’s Trademark Lawsuit Against “Mormon Stories” Podcast, EFF Urges Court

The Electronic Frontier Foundation has filed a legal brief defending the podcast Mormon Stories against a trademark lawsuit from the Church of Jesus Christ of Latter-day Saints. Per the EFF, the church is misusing trademark law to control speech and suppress criticism about Mormonism and Mormon culture. The brief urges the court to dismiss the case and adopt the Rogers test—a legal standard that gives stronger protection to expressive speech when trademarks appear in creative works. The EFF points to the church's history of similar trademark claims against other podcasts and nonprofit organizations, and argues that allowing such cases to proceed would give trademark owners power to control entire topics of public discussion.
