Dismiss Church’s Trademark Lawsuit Against “Mormon Stories” Podcast, EFF Urges Court

The brief urges the court to dismiss the case and adopt the Rogers test—a legal standard that gives stronger protection to expressive speech when trademarks appear in creative works. The EFF points to the church's history of similar trademark claims against other podcasts and nonprofit organizations, and argues that allowing such cases to proceed would give trademark owners power to control entire topics of public discussion.
